          This complaint coming for on this day for sworn affidavit of complainant in the presence of Sri.C.Raghava Reddy, Advocate, Kurnool for complainant and Sri.I. Anantha Rama Sastry, Advocate, Kurnool for Opposite Party and after perusing the material papers on record, the Forum made the following.

 

O R D E R

 

 

          Memo submitted for the complainant’s side as to settlement out of Forum without furnishing the necessary particulars as to whether it is post or prior to complaint.  No representation for complaint for giving any clarification.  While such is so the opposite party’s counsel submits the required due payment was made to the complainant on 31st October, 2005 and filed an acknowledgement issued by the complainant and written version of the opposite party also envisages the same.  Hence, the complaint appears to have been filed without proper cause of action vexatiously.   Therefore, this is a fit case where the opposite party has to provide with costs for vexatious litigation of complaint.  Consequently, the complaint is dismissed with costs of complaint ordering an amount of Rs.1,000/- as to costs to be paid by the complainant to opposite party within a month of the receipt of this order.
