Shri S. K. Ojha, Member : - In brief, the case of complainant is that, the complainant had insured himself with the O.P. and taken a Life insurance policy in the year 2005 of having Sum Assured of Rs.50,000/- only and paying quarterly premium of Rs.1,167/- only against policy No. 593003563. The complainant paid last premium on dtd. 05.11.2016 at LIC Divisional Office, Sambalpur while the policy was matured on 14.02.2017 but in the statement dtd.07.11.2016 of O.P the said last premium paid was not shown. The complainant also alleges that the O.P has taken Rs.56,016/- only while the policy was of having Sum Assured of Rs.50,000/- only. The agent of the O.P had assured to get Rs.1,00,000/-only at the time of maturity but the complainant received less amount after maturity, hence this case.
The O.P appeared through his counsel after being noticed, filed written version and submitted the facts of the life insurance policy in question. The O.P further submitted that, the premiums were taken as per prescribed table and term of the policy and after maturity, the maturity amount of Rs.73,800/- only has been credited to the bank account of the complainant on dtd. 14.02.2017 without deduction of any unpaid premium. The alleged last premium paid dtd. 05.11.2016 was not credited in the statement dtd. 07.11.2016 but after maturity the full maturity amount was paid without any deduction. Denied all the allegations prayed for dismissal of case.
Heard from both the sides and gone through the record. The complainant had taken LIC policy bearing No.593003563 of having Plan and Table 91-12 with quarterly premium of Rs.1,167/- only, Sum Assured Rs.50,000/- only. The date of commencement was 14.02.2005 and maturity date was 14.02.2017. As per prescribed Plan and Table of the O.P, the complainant was paying the premiums. The O.P paid maturity amount of Rs.73,800/- only calculated as per terms and conditions of the policy without deducting any unpaid premium which was credited in the bank account of the complainant on the date of maturity i.e dtd. 14.02.2017.
All around basing on the above mentioned facts and circumstances this Hon’ble Forum not found any deficiency in service or adoption of any unfair trade practice by the O.P on the part of complainant hence, the complaint case is hereby dismissed with no costs.
Accordingly the case is disposed of.
Order pronounced in the open court today on this the 20th day of July’ 2017, copy of this order shall be communicated to the parties as per rule.
