JUDGMENT

The  curx of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps for  non  payment of Maturity  value interest from 14.5.2016 till realisation for which  the complainant  sought compensation  inter alia  for redressal of the grievances raised by the complainant.

On being noticed the O.P.  had   issued cheque  in favour of the complainant  and sent Rs.158/- to the complainant  in shape of  cheque   No. 80460 Dt. 17.12.2016 for the period  from 14.8.2016 to 18.10.2016  @ Rs.9%  per annum  which was also received by the complainant..(Copies of the  cheque and letter Dt. 17.12.2016  issued by the O.P. which are marked as Annexure-I & 2).

The complainant  on Dt. 26.12.2016   filed memo stating that he received  an amount of Rs. 158/- paid by the O.P. through cheque vide No. 80460 Dt. 17.12.2016.  The complainant  prays the forum in his memo stating that the forum to pass an order by  directing the O.Ps to pay the cost of litigation and compensation of the case.

During  the course of hearing  the complainant  was absent on repeated  call.

                On verification of record  this forum  found that   the complainant  is  remaining absent since long though   several adjournments have been granted for which the case is lingering.              It is presumed that the complainant is  not interested to proceed further  with the case. Hence the complaint petition is dropped.

Hence  to  meet the  ends of justice, the following order is passed.

ORDER.

In  resultant the  petition of the complainant is dismissed on default.  Parties are left to bear their own   costs.
