The Complainant files hazira.

The O.P. No.3 files lawyers hazira.

The Ld. Agent of the O.Ps, LICI file a petition along with a cheque bearing No.416193 dated 14/02/2007 in favour of the Complainant and has on agree that the cheque may be handed over to the Complainant towards their full and final settlement.

Copy served and no objection raised.

The Ld. Agent of the Complainant and the O.P. No.3 and the O.P, LICI have submitted that the case has been amicably settled and the case may be dismissed.

The Complainant has filed petition also for returning the original Policy being No.34975506 filed by them.

The Ld. Agent has submitted that they will again return the same to the Ld. Agent of the O.P, LICI.

Copy served and no objection raised.

It appears that the case was filed for hearing of argument. At that stage the Ld. Agent of the Complainant filed a petition on 12/02/2007 praying for dismissing the case as the case has been amicably settled with LICI and Bank also and the LICI has taken step for payment by issuing cheque.

As and when the parties have amicably settled the case.

The prayers are liable to be allowed and the case is liable to be dismissed in terms of the compromise.

Return the cheque bearing No.416193 dated 14/02/2007 amounting Rs.9,628/- in the name of Sunil Kr. Saha to the Complainant, Sunil Kr. Saha on proper identification and receipt.

The Ld. Agent of the Complainant has filed the receipt acknowledging receipt of the cheque.

Return also the original policy being No.34975506 to the Complainant on proper receipt on completion to resubmit the same if called for.

In the result it is ordered

            That the case be and the same is dismissed in terms of the compromise petition and thus disposed off.
