Both parties are present by filing hazira through their Ld. Agent.

The case is taken up for hearing of argument.

At this stage of the case, both parties have filed a joint petition praying for disposing of the case on the ground of settlement. Parties have filed also Xerox copy of cheque and the declaration of the Complainant.

Heard the Ld. Agent of the both parties.

It is submitted that the Complainant has received cheque from the O.P and the Complainant is not willing to proceed with the case.

Seen the joint petition which is signed by both parties and the Ld. Agents of the both sides. The Ld. Agent of the Complainant undertakes to file receipt from the Complainant and the receipt is filed which be kept with the record.

In such circumstances the case is liable to be dismissed on compromise.

Hence,

                Ordered,

                                That the case be and the same is dismissed for non-prosecution on compromise.
