Final Order / Judgement

               Learned counsel for the petitioner is present.

2.             Heard the learned counsel for the petitioner. He submitted that he has filed the consumer complaint No 07 of 2021 on 15.01.2021. He further submitted that on that date the hearing could not be taken up due to observation of the President-in-Charge that the Lady Member present in the  District Commission did not co-operate. In support of his submission he filed copy of the order dtd.15.01.2021. He submitted that he is compelled to file present petition  in the judicial side to bring unusual order to the notice this Commission.  

3.       Considered the submission of the learned counsel for the petitioner, perused the impugned order. It is mandate of the Consumer Protection Act,2019 for hearing of the complaint case by the District Commission comprising of two members. The  question of co-operation and non-cooperation of any member can not be tolerated when the members are working under  statute This matter would be taken in the administrative side. However, this Commission directs both the members to be careful and take note of this order to the effect that the litigants should not be allowed to suffer for their non-participation. When the members are duty bound to protect the interest of the consumer which is avowed object of the Consumer Protection Act, they should bestow their personal attention to the object of the Act.

   In view of the above, this  revision petition is disposed of with a direction to both the members to pass necessary order on the complaint filed by the petitioner and hear the same as per the provisions of the Consumer Protection Act,2019. It is expected that there would be no any such order  to be passed  in the future. Learned counsel for the petitioner is directed to appear before the learned District Commission,Angul on 4th February,2021 and take further instruction.

        The revision petition is disposed of accordingly.

         The Secretary I/C of this Commission is directed to communicate the above order by mail to the District Commission, Angul.
