ORDER

Learned Counsel Mr.Saikat Rahman is present for the complainant.
We heard Mr. Rahman about admission of the complaint.
From the record it appears that several adjournment was given on the prayer of the Counsel to satisfy the court by producing documents about the primafacie of the case. But no documents submitted. Mr. Rahman submits that during trial they will produce documents and prove, if the complaint is admitted.
The facts of the case in brief is that the husband of the complainant purchased a vehicle (Hyundai Santro) after obtaining loan from the O.P. Bank. But unfortunately after few days i.e., on 17.01.2020 the husband of the complainant died, who was the borrower of the loan. The loan amount was Rs.5,78,990/-. After obtaining the loan  when all the documents were supplied to the complainant including Insurance copy they found that without securing the whole loan had done by the O.P. but one accidental policy in the name of the husband of the complainant which is totally contradictory with the words which the O.P. bank has stated to the husband of the petitioner initially. The husband of the complainant on several occasion went to the office of the O.P. and requested to make insurance policy for the borrower. But every time O.P. assured that they will take care of everything and borrower need not worry. Relying on the assurance given by the O.P. the borrower kept hope upon the O.P. that they would make the insurance policy. After the death of the husband of the complainant she surprisingly got a reminder from the O.P.  bank for payment of monthly installments of the loan and the complainant became astonished. Thereafter, complainant sent a reply asking for all relevant documents related to the demise of her husband but surprisingly there was no mention regarding the insurance coverage of her husband whole loan amount. Hence, the complainant filed this complaint alleging negligence and deficiency of service of the O.P. The complainant side submitted 4 papers namely letter written by Mina Debbarma(Bhowmik) to the Branch Manager, O.P. Bank regarding information of death of her husband, 1st reminder, issued by the Bank addressed to Ratan Bhowmik, Co-Borrower and Rajib Bhowmik, Borrower, one letter addressed to Mina Debbarma(Bhowmik) who is the present complainant issued by the Bank dated 27.04.2020 and one letter of reply given by Mina Debbarma(Bhowmik) to the Branch Manager, Indusind Bank, Agartala.
We have perused the complaint petition as well as the documents annexed with the petition but we do not find any primafacie case to establish that there is any negligence or deficiency in service on the part of the O.P. bank. Moreover, complainant failed to submit necessary papers /document to justify a consumer dispute. Accordingly we are not inclined to admit the complaint and it is rejected.
