 The complainant’s case in brief is that on 26.08.2023 around 12:11 p.m the complainant  Bappa Santra went to the ATM of the OP NO.2 Punjab National Bank, Chapra Branch ATM I.d No.P3033020, at vill. Polianpur, P.O. Ichhapur, Dist. Nadia to withdrawal of Rs.10,000/- by his ATM Card issued by the OP No.1 Indian                               Bank, Ichhapur   Branch    through    the    push      the      card in the ATM Machine for the withdrawal but unfortunately, he did not receive the money from the ATM Machine and received a message in  his mobile that the amount of Rs.10,000/- has been debited from his bank account No.59131125694 and CIF No.39129682116 of Indian Bank,    Ichhapur   Branch which is lying with the OP No.1 he made complainant to the OP No.1 on 07.09.2023.  But in vain  ,hence this case.

The complainant filed an affidavit regarding service of notice  upon the opposite parties. As per the affidavit service of notice by the complainant. The notice  served upon both the OP No.1&2. The OP NO.1 appeared  but failed to  file W/V within time and the OP No.2 did not contest the case. Accordingly,  the case is heard ex-parte against both the OP No.1&2.

The complainant filed relevant documents and affidavit on evidence. The same remained and unchallenged, since  the case is heard ex-parte.

The entire oral and documentary  evidence  of the complainant  could not be discarded  by  the opposite parties since the case is heard ex-parte.

Consequently, the complaint case succeeds against the OPs.

          that the case of the complainant Bappa Santra is allowed ex-parte against both the opposite parties.

The Opposite parties are directed  to make payment  of  Rs.10,000/- (Rupees ten thousand) to  the complainant together with interest @10% p.a on and from 26.08.2023 till the date of payment

The OPs are also directed to pay the compensation of Rs.10,000/- (Rupees ten thousand) for mental pain and agony and harassment of the complainant.

They are also directed to pay Rs.5,000/- (Rupees five thousand) to the complainant towards litigation cost of the  case.

The OPs are directed to pay the award money to the complainant within 30 days from the date of passing the final order, failing which the entire award money shall carry an interest @ 10% p.a  from the date of final order till the date of its realisation.

All interim application (I.A) stands disposed of accordingly.

                                      D.A. to note in the trial register.

                                      The case is accordingly disposed of.

          Let a copy of this final order be supplied to both the parties as free of costs.
