F I N A L O R D E R
27.01.2023- Learned counsel of the complainant is present.
The case has been proceeding exparte against the O.P. vide order dated 29.12.2021. The case of the complainant that she obtained Education Loan for an amount of Rs.7,50,000/- with an EMI of Rs.14,470/- per month. The complainant has duly paid the EMIs and thereafter prayed for a Clearance Certificate from the O.P. The O.P. refused to grant such certificate on the ground that the complainant has to pay more money as due. Hence, this complaint by the complainant. The complainant has prayed for a direction to the O.P. Bank for issuing Clearance Certificate and also for compensation. The complainant has submitted more than 70 nos. of payment slip issued from the Bank.
The O.P. inspite of receiving notice has failed to appear and dispute the claim of the complainant.
Hence, the O.P. bank has admitted the claim of the complainant that no amount is due.
Which is why the O.P. Bank has not taken any defence. Hence, we find no impediment to dispose the case with a direction to the O.P. No.1 to issue Clearance Certificate to the complainant within 15 days. However, we do not award any compensation for for such deficiency in service.
Communicate a copy of this order to the Branch Manager, Indian Bank, Agartala Branch at the address of the O.P. No.1, so that they can comply this order immediately.
The complainant shall appear before the Branch Manager after 12 days from today to obtain the Clearance Certificate within 15 days from the date of receiving this order.
Also supply a copy of this order to the complainant.
The case stands disposed off.
