FINAL ORDER / JUDGEMENT

Complainant is present by filing hazira.

The case is fixed for Ex-Parte hearing.

No step is taken by the O.P. who is found absent on repeated call.

The complainant’s case is that the O.P. Bank on various dates deducted Rs.500/- on 28-06-2017, Rs.590/- on 31-07-2017, Rs.590/- on 28-08-2017,  Rs.590/- on 19-09-2017, Rs.590/- on 27-10-2017, Rs.590/- on 27-11-2017, Rs.590/- on 31-12-2017, Rs.590/- on 24-01-2018 and lastly Rs.590/- on 03-02-2018 and thereafter no deduction was made for not maintaining minimum balance. The complainant approached the O.P. Bank several times but to no effect. The matter was also dealt with by the concerned C.A. & F.B.P., Bankura Region which also yielded no result. Ultimately the complainant has approached the Commission for appropriate relief. In support of the claim the complainant has produced relevant Pass Book in respect of his Account No.0713104000194556 of IDBI, Bankura Branch which shows that on all the above mentioned dates of deduction the complainant had sufficient balance with the said Account.

The Bank Authority has violated the Banking rules by deducting the aforesaid amounts totaling Rs.5,220/- from the account of the Complainant and this act on the part of the Bank Authority amounts to deficiency in service and the Commission has jurisdiction to redress the grievances of the complainant by passing appropriate order. It is the duty of the Bank Authority to show the rule of deduction for maintaining minimum balance but the Bank Authority has not come forward before this Commission to discharge their duties.

Hence,  it is ordered……….

 

That the case is allowed Ex-Parte against the O.P. The O.P. is directed to pay to the complainant Rs.5,220-/ to the above mentioned Account along with compensation of Rs.5,000/- within a month from this date failing which the O.P. will bear the compensation of Rs.15,000/- as claimed in this case.

 

Let a copy of this order be given to the parties free of cost. The complainant is directed to serve the copy of this order upon the O.P. by Speed Post.
