              Complainant is present. Today is fixed for ex-parte hearing Hd. the Ld. Advicate and perused the documents. It appears that the complainant filed relevant documents showing that he made repayment of total loan of 5,000/-(Five thousand) only taken from the Op-IDBI Bank. At the time of sanctioning   loan, the bank authority took share certificate of different co. as security deposit.

              On repayment of the loan amount with interest, Op-Bank returned the share certificates but delayed the matter as the growth of share was high in spit of repeated request of the complainant lastly on 02/05/2013. As a result the complainant sustained loss of 91,614/-. Being aggrieved, the complainant has come before us with a prayer for compensation of 91,614/-(Ninety one thousand six hundred fourteen) only.

               In view of the fact it is crystal clear that the Op avoids to return back the share certificates.

               So, it is a fit case to hold the complainant has proved the allegation of deficiency in service against the Op.

            Hence,

                        Ordered,

                                      that the complaint case be and the same is allowed exparte. The complainant do get the refund of 91,614/-(Ninety one thousand six hundred fourteen) only payable by the Op-Bank  within 60 days from the date of this order, in default, this complainant is at liberty to proceed with the matter in accordance with the Provision of law in this behalf.

               There is no order for litigation cost.
