The Complainant filed complaint U/S 12 of C.P Act, 1986 the brief fact of the complaint is that he is subscriber of insurance policy No.30011517286/00/000 from O.P on payment premium Rs.42,342/- for his vehicle. The policy was valid on 09.12.2016 to 08.12.2017. the of windshield glass of vehicle was broken on 01.05.2017 while the vehicle was playing towards Kuchinda from Deogarh near village Pravasuni due to contact of stone coming from truck tyre while passing on the road. The complainant intimate to the O.Ps. The O.Ps departed his surveyor who assess the damage but could not taken to account about the damaged caused to his vehicle by the hit of motorcycle. The complainant, while approached the surveyor he did not believe the claim of complainant regarding damage due hit by motorcycle on the ground of false and improbable report so that the complainant sustained loss, Mental agony and claim compensation of Rs.80,000/- Rs.20,000/- for mental agony Rs.5,000/- towards cost of litigation. On the other hand the O.P appeared and filed their version admitting damage of windshield glass of the vehicle immediately after receiving information deputed IRDA License, surveyor and loss assessor Sri Rasmi Ranjan Rout to visit the spot, submitted report assessing loss of Rs.8,075.99/- paisa and advised to make it repair with authorised repairer. The repairer M/S. Nabdurga Motors Pvt. Ltd., Rourkela, who repair the same as per garage settlement Rs.8,076/- and was paid by the O.Ps after deducting tax and TDS through NEFT. The O.P denied the other averments made in the complaint and to prove his case the O.Ps filed surveyor report.
On the basis of above observation and documents available in record we are of a considerate view that there is no deficiency in service and unfairness on the part of the O.Ps. The O.Ps has taken prompt action to settle the claim accordingly paid required amount to the concerned repairer. Hence the complainant failed to prove his claims by not adducing proper evidence. Accordingly the case of complainant is dismissed on contest without cost.
