On perusal of the case record, It appears instant case was filed on 25.02.2023 and notice was issued to the o.p on 09.03.2023 thereafter case was pending for appearance of the o.p. Reminder notice was also issued to the o.p on 30.08.2023. O.p has appeared on 16.09.2023 and O.p has filed w.s with cost of Rs- 500/- on 13.12.2023. Thereafter this record is running for evidence of the complainant since 30.12.2023. The complainant has been continuously absent since 30.01.2024 and even after four months have passed, no witness has appeared on his behalf. So Evidence of complainant was closed on date- 24.04.2024. Thereafter the case was fixed for the evidence of the O.P. on 16.05.2024 but the O.P. has also not given evidence till now. Both the parties are continuously absent since 03.08.2024. On 20.09.2024 last chance was given and on 14.10.2024 again last chance was given to the complainant and opposite party to produce his evidence but to no avail. It appears that the complainant has no interest in the case and accordingly the instant case is hereby dismissed due to default of the complainant.
