Today is fixed for admission hearing of this case.  The complainant filed this case against the O.P., ICICI Bank and WBSEDCL with a prayer to disconnect the electricity line given to one Santosh Kr. Dutta who is coparcener of the petitioner that a civil suit is pending before the Ld. Sub-Judge, Burdwan Court being Title Suit No.152/2015 and an order of injunction in favour of the ICICI Bank has been passed by the Ld. Court.  The petitioner alleges that Santosh Kr. Dutta suppressing the fact obtaining the electricity connection and therefore, he prays for disconnection of the said electricity line.   After hearing the complaint it appears that the complainant is not a consumer in connection with this case and the electricity connection received by the said Santosh Kr. Dutta cannot be disconnected with the prayer of the petitioner by this Forum.  As the civil suit is pending between the complainant and his coparcener, the petitioner has every right to agitate the issue before the Civil Court and this case filed by the petitioner before this Forum praying for disconnection of the electricity line, is not within the purview of this Forum and therefore, the petition is rejected.  Hence, it is

Ordered

that the consumer complaint case be and the same is rejected without any cost.

Let the copies of this order be supplied to the parties free of cost.
