                 Present appeal is filed against the order dated 22.02.2017 passed by the Consumer Disputes Redressal Forum-(III), Janak Puri, New Delhi in CC No.480/2010 whereby the complaint of the complainant was dismissed in default for non-appearance of the complainant.

                 It is stated by the appellant that she was busy in some other court and reached to the District Forum late, by that time the complaint was already dismissed for non-appearance.

                 In support of the contention of the complainant has filed his own affidavit.

                 Initially respondent opposed the appeal, but after some arguments, counsel for respondent states that she has no objection if the complaint was restored and matter be heard on merits.

                 In view of above order dated 22.02.2017 is set aside and appeal is allowed and complaint is restored to its original position.

                 Appellant/complainant is warned to be cautious in future.

                 Parties are directed to appear before District Forum on 31.03.2020. Thereafter, District Forum shall proceed in the matter in accordance with law.

                 File be consigned to record room.
