Ld. Advocate for the complainant submits that on 4th July, 2023 and again on 28th July, 2023 the opposite party intimated the complainant/petitioner that they would sell mortgaged gold ornaments lying in its custody for realization of the alleged outstanding dues.
In reply, Ld. Advocate for the opposite party raised strong objection against the submission of the complainant’s Advocate.
Ld. Advocate for the opposite party submits that the opposite party never over phone either on 04/07/2023 or 28/07/2023 informed the complainant that they would sell all the mortgaged gold ornaments.
Ld. Advocate for the opposite party submits that the opposite party has no intention to sell of the mortgaged ornaments of the complainant during pendency of CC/29/2022.
Therefore, the Misc. Application dated 10/08/2023 is allowed on consent without cost.
The opposite party is hereby restrained by an interim order not to sell the mortgaged ornaments/gold of the complainant till disposal of CC/29/2022.
Thus, the Misc. Application No.MA/257/2023 is disposed of.
