Order No.4, Dated: 27.03.2015

 

Today is fixed for ex-parte hearing.  The complainants file hazira.   The O.Ps. appear through their Ld. Advocate and file hazira, vokalatnama, a petition intimating that the O.Ps. have paid the claim amount of Rs.80,000/- by bank draft, copy of bank draft for Rs.80,000/- and a petition praying to set aside the ex-parte hearing order.  Let the same be kept with the record.

                The petition praying for vacating the ex-parte order is taken up for hearing. The petition is duly supported by affidavit.  Copy served.  No objection raised.

                The ground mentioned in the petition is sufficient.

                Hence, the prayer is allowed.  Accordingly, the ex-parte hearing order passed against the O.Ps. is hereby set aside. 

                The complainants file a petition intimating that the O.Ps. have paid the claim amount of Rs.80,00/- to them by bank draft.  The petition is duly verified.  This petition and the petition of the O.Ps. by which they have intimated the Forum that they have already paid the claim amount of Rs.80,000/- are taken up for hearing.  By the petition as mentioned, the complainants have stated that they have received the claim amount of Rs.80,000/- and as such they are not willing to proceed with this case further.  Heard both the sides.  The ground mentioned in the petition is sufficient.  So, the petition filed by the complainants should be allowed.

                Fees paid is correct.  Hence, it is

ORDERED

that the petition filed by the complainant this day is allowed.  Accordingly, the case is dismissed for non-prosecution without any cost.  Let the copy of this order be supplied to the parties free of cost.
