Final Order / Judgement

Perused the complaint petition, written version and the documents available on the record. The dispute arises in this case is relating to calculation of outstanding amount in the account statement. Any Account dispute in between the parties does not fall with the ambit of consumer dispute. But the same is a civil dispute. Further we are not expertise to ascertain the charges calculated by the OP in the statement of account to be correct or not when the same is disputed by the Complainant. This complaint raises complicate issue which cannot be decided in summary jurisdiction. It is found that there is no specific prayer and evidence submitted by the complainant against the OP. The Complainant has suppressed the actual facts of the matter and also not given any evidences regarding allegations mentioned in his petition. Even in due course of time the Complainant is not able to pay the required EMIs in due date and became a regular defaulter with the result a huge outstanding amount till date. Complainant cannot sleep silent and escape from his liberty. It is the duty of the Complainant to pay the EMIs in time, Hence, the case of the complainant is liable to be rejected as on merit. There shall be no cost to either party.

Close the case accordingly as no merit of the complaint petition.
