Final Order / Judgement

Case record is advanced to-day on the strength of put up petition filed by learned Advocate on behalf of Complainant. Learned Advocates for both parties are present. OP-Company received the D.D. bearing No.004294 Dtd.05.03.2019 of Rs.3,00,000/- (Rupees Three lakhs) only to-day for loan Account No.XVFPRA 00002064633 for compliance to the interim order dtd.10.10.2018 passed by this Forum in I.A.No. 36/2019 as well as Memorandum of Understanding (MOU) signed by both parties from this Forum. Complainant files a petition through his Advocate stating that the complainant wants to withdraw the C.C. Case as per  Memorandum of Understanding (MOU) dtd.23.02.2019 signed between the parties and as per order dtd.12.03.2019 passed in R.P.No.07 of 2019 by Hon’ble State C.D.R. Commission, Orissa, Cuttack. Further the complainant submit that as per MOU signed and agreed by both parties, the Opposite Parties should not repossess the vehicle of the complainant for six months from to-day and the complainant should pay his regular installments in time without any follow-up by the OPs. The OP should be received the payment against the loan account as per the complainant desire for clearing up the backlog EMIs dues pending against the loan account within the period of six months from to-day. That on the event of failure of this MOU terms and condition by both parties, other party shall intimate same to the other party by writing. That any violation of terms and condition of this MOU by the party, the other party after due intimation will take proper legal action as per law against the other party In proper court of law. Hence, the complainant seeking permission to allow the withdrawal petition as per MOU signed by both parties as well as order of the Hon’ble State C.D.R. Commission, Orissa, Cuttack. Copy served. Learned Advocate for the OPs files Original Certified Copy of order dtd.12.03.32019 in R.P.No. 07 of 2019 passed by the Hon’ble State Commission.

    Heard the said petition filed by the Complainant and it is allowed. In view of the said petition the present C.C. is disposed of as withdrawn.
