Parties are absent on call. No evidence on affidavit filed.

 Complainant remaining absent on the date fixed for hearing. However, in view of Sec 38 (6) of C.P Act 2019 case is taken up to decide on merit. Perusal the material on record.

As per sec 38(6) of C.P Act every complaint shall be heard by the District Commission on the basis of affidavit and documentary evidence placed on record. Law is well settled that complainant is to prove the allegation made against the O.Ps but here complainant has failed to adduce cogent evidence to substantiate his claim.

We are of the opinion that this complaint sans merits. Hence dismissed. However, no order as to cost.
