The complainant is present in person, as well as through his Ld. Advocate. The OP 1 and 2 have entered appearance by filing Vokalatnama and prays for filing W/V. At this juncture the complainant has filed one petition stating that as his grievance have already been redressed by the OPs out of Court; he is not willing to proceed further with this complaint. By filing this application the complainant has prayed for dismissal of this complaint.

In view of the application filed by the complainant we are of the opinion that as the complainant is not interested to proceed further with this complaint as the dispute has already been redressed by the OPs amicably out of the Court; hence the complaint is dismissed for non-prosecution.

 

Hence it is ordered that the CC 89/2018 is hereby dismissed for non-prosecution.

 

Let plain copy of this order be supplied to the parties free of cost as per the CPR, 2005.
