Smt. Anamika Nanda, Member (W): - The brief facts of the complainant’s case is that, the complainant is a registered owner of one vehicle bearing Regn. No.OD16-8820 which has been financed by the O.P for an amount of Rs.6,00,000/- only including interest which the complainant was liable to pay the loan amount of Rs.12,748/- only per month in 60 nos. of  monthly installments. The complainant was paying the monthly installments regularly, but due to some unavoidable circumstances the complainant could not paid some of the installments in time for which the O.P has seized the vehicle on dtd. 23.01.2017 without any notice or information, hence this case.

Being noticed through this Forum, the O.Ps. neither appeared before this Forum nor submitted their  written statements and after being providing sufficient opportunities the O.Ps  set ex-parte ultimately.

Heard and perused the case record along with materials available. It is found that the complainant has availed financial help from the O.Ps. and has already paid Rs.3,07,781/-  including principal and interest. The O.Ps. have complied the misc case order bearing No. 07/2017 dtd. 06.02.2017 and released the vehicle in favour of the complainant. 

As per the above observations and analysis the complaint petition is hereby allowed partly with directions to the O.Ps. to issue afresh statement of accounts and receive the dues amount from the complainant if any. 

            Accordingly the case is disposed of.

Order pronounced in the open court today the 11th   day of July’ 2017 and copy of this order shall be supplied to the parties as per rule.
