Complainant herself files hazira.  

The record is taken up for admission hearing.

Heard the complainant. Perused the case record and the documents so filed.

Complainant, Duraksha Khatun, being the daughter of Late Molla Mafidul Islam, has filed this complaint against the OP stating that the OP - Bank did not allow her mother to operate the Locker A/C (124) lying with the OP on the ground that the father of the complainant has a bank A/C No. 0188101000733 under the OP along with the complainant. But father of the complainant had a locker being No. 124 and key No. 112 jointly with her mother, Joynoba Khatun and after the death of her father, her  mother became the sole owner of the same as it was either or survivor basis and her father died on 16.04.2019. After the death of her father, the complainant made it single and charges for the locker was being deducted from her Savings A/c as mentioned above.

The complainant also alleged that on being requested through the Advocate’s letter to operate the Locker by her, the Bank did not allow her to operate the same and demanded Legal Heir Certificate. From the documents so filed, it appears that the father of the complainant died on 16.04.2019 leaving behind Joynoba Khatun (wife), Duraksha Khatun (daughter), Najma Khatun (daughter) and Molla Tanjir Ahmed (son) as per certificate issued by Asansol Municipal Corporation. The complainant did not make her mother Joynoba Khatun and other Legal Heirs as party to this case and according to her case, her mother is the sole owner of the Locker and her mother is also not forthcoming as a Consumer with a prayer to operate the locker lying with the OP Bank.

In respect of the above findings, we are of opinion that the complainant is not at all a “Consumer” under the C.P. Act, 2019.  Accordingly, we do not find any reason to admit the case.

Hence, the case is not admitted and thus disposed of.

Let a copy of this order be given to the parties on free of cost.
