JUDGEMENT
The crux of the case is that the above named complainant alleging deficiency in service against afore mentioned O.Ps for non refund of deposited amount towards policy No. 0213364416 for which the complainant sought for redressal of the grievances raised by the complainant. The brief facts of the case has summarised here under.
On being noticed the O.Ps appeared through their learned counsel and filed written version refuting allegation made against them. The O.Ps taking one and another pleas in the written version sought to dismiss the complaint as it is not maintainable under the C.P. Act, 1986. The facts which are not specifically admitted may be treated as denial of the O.Ps. Hence the O.Ps prays the forum to dismiss the case against them to meet the ends of justice.
Heard arguments from the learned counsel for the O.Ps and from the complainant. Perused the record, documents, written version filed by the parties.
This forum examined the entire material on record and given a thoughtful consideration to the arguments advanced before us by the parties touching the points both on the facts as well as on law.
FINDINGS.
On perusal of the record it is revealed that there is no dispute that the complainant was a policy holder bearing No. 0213364416 with a yearly premium a sum of Rs.5,440/-and sum assured was Rs.50,000/- opted policy product. Name i.e. Cash gain Economy insurance policy commencement date. 29.03.2011. Further there is no disputes the above policy premium payment term is 15 years. Again there is no dispute the complainant had paid one instalment amount a sum Rs. 5,440/- till Dt. 30.03.2012 (copies of the deposit slip and policy bond are are in the file which are marked as Annexure-1 & 2 ).
The main grievance of the complainant is that to refund all deposited amount with bonus, interest when asked the O.Ps had stated that the amount was invested in the share market and s not having any profit in the said investment and as such the complainant will not get any refund. Hence the C.C. petition filed by the complainant to get the deposited amount.
It further appears that prior to filing of complaint, the complainant had issued legal notice through its counsel on Dt. 17.09.2018 and it was duly served on the O.P.(Copies of the legal notice is in the file which is marked as Annexure- 3) but they failed to furnish reply to the said notice(copies of the postal acknowledgement is in the file which is marked as Annexure-4). Hence it appears that the O.Ps have been negligent and callous regarding the complaint of the complainant. So the complainant filed this C.C. case before the forum.
.In written the O.Ps contended that the complainant had paid only one premium of Rs. Rs.5,440/- only and he defaulted to pay his further premium amounts from Dt. 30.03.2012.
In written version the O.Ps again contended that as per the IRDA policy condition if any insurer fails to pay the premiums regularly, as per agreed terms, then the insurance company will not have an obligation to refund the premiums already paid by the complainant.
In written version further the O.Ps contended that the complainant is not entitled for the surrender value of premiums he paid already..
In written version the O.Ps again contended that the complainant was issued with letter by the O.Ps. asking him 15 days free look period for her acceptance or disagreement with the policy. The O.Ps did not get any disagreement from the complainant and as the O.Ps believed to have accepted the policy by the complainant. The complainant was supplied with the product circular for her verification of product.
During the course of the hearing the complainant is present in person before the forum. This forum observed since the complainant is daily labour and they have no such income to pay the premium to regular the policy. Further they have not known English language to know the policy condition. This forum further observed the deposited amount is highly necessary for their livelihood.
At this stage this forum observed the interest of justice would met if the O.Ps. disbursed full deposited amount in favour of the complainant.
In view of the above discussion relating to the above case and In Res-IPSA-Loquiture as well as in the light of the settled legal position discussed as above which is Aliance Juris. Hence we allow the above complaint petition in part.
Hence to meet the ends of justice, the following order is passed. ORDER.
In resultant the complaint petition is allowed in part on contest against the O.Ps.
The O.Ps ordered to refund the full deposited amount in the policy No. 0213364416 in favour of the complainant without any interest. There is no order as to costs and compensation.
The OPs ordered to make compliance the aforesaid Order within 30 days from the date of receipt of this order.
Serve the copies of above order to the parties free of cost.
