Heard the Ld. Advocate for the Complainant in the matter.
The complaint case originates over repudiation of Complainant’s insurance claim for a sum of Rs. 15,18,878/- by the OP Insurer. Besides this amount, the Complainant has also prayed for compensation amounting to Rs. 5,00,000/- and litigation cost for a sum of Rs. 50,000/-.
On going through the petition of complaint, I find that, in this case the policyholder passed away on 20-03-2018 and Complainant’s claim in this regard was repudiated by the OP Insurance Company on 31-05-2018.
It appears from the office record that the instant complaint case was filed on 24-07-2018, i.e., within 2 months of repudiation of Complainant’s claim. The Complainant though claimed compensation to the tune of Rs. 5,00,000/-, the Ld. Advocate could not offer any satisfactory explanation behind claiming such whooping sum as compensation. It is always desirable that the extent of compensation claimed should be realistic and reasonable. There is every reason to believe that with the sole objective of attracting the jurisdiction of this Commission and bypassing the Ld. District Forum, such exorbitant sum has been claimed as compensation which cannot be encouraged under any circumstances.
Accordingly, I am not inclined to allow this complaint. The complaint case is dismissed as such. Complainant is directed to move the appropriate District Forum for agitating his grievance.
