Brief facts of the case:-
Case in hand is the allegation of deficiency in service and unfair trade practice by the O.Ps not to claim of Rs.41,997/- from the credit card No. 4514570005980555 which was a fraud transaction for which the complainant sought redressal.
The O.Ps appeared through their learned counsel and filed written version. In the written version they preliminary contended that the case is not maintainable before this commission as this is a cyber crime .
The complainant is absent on repeated call.
On perusal of the record it is revealed that the complainant using credit card No. 4514570005980555 of O.Ps(Bank). On Dated. 8.2.2022 in shape of fraud transaction withdrawn a sum of Rs. 41,997/- by some one from the credit card No. 4514570005980555 of the complainant. In this connection the complainant had also filed F.I.R. in the Rayagada Police Station on Dtd. 10.2.2022 (copies of the same is available in the file). This is a offence of cheating over mobile call and a Cyber crime.
On perusal of the complaint petition this Commission observed complaints which are based on allegations of fraud and forgery are not to be entertained by Consumer Commission. In our view , having regard to the nature and gamut of controversy which is raised in the present complaints, it can not be decided by a Consumer Commission in exercise of its summary jurisdiction under the Consumer Protection Act, 2019 because the trial of such complaints would require voluminous documentary and oral evidence including cross examination of various witness and experts, which can not be possibly be done by this Commission in such a jurisdiction. The trial and disposal of such complaints can not be done within the stipulated time span of 3 or 4 months or even a year or so as it would require protracted trial and hearings.
That the matters relating to offence of cheating over mobile phone and Cyber crime will not comes under the purview of the C.P. Act, 2019. This commission has lack of jurisdiction to adjudicate the dispute relating to the fraud transaction in the credit card. Hence the case is not maintainable in view of the above discussion.
The grievance of the complainant not to claim Rs.41,997/- by the O.Ps(Bank) towards credit card can be raised before the appropriate court of law and not before this commission. We do not think proper to go into merit of this case.
Hence, the claim of the complainant can not be accepted under the provisions of the C.P. Act. It is open to complainant ordinary remedy to approach the court of competent having its jurisdiction.
The period spent before the Consumer Commission could be excluded, while calculating the period of limitation, as contemplated Under Section -14 of the Limitation Act, 1963.
Miscellaneous order if any delivered by this commission relating to this case stands vacated.
