Presented by Smt. Jigeesha Mishra, Member(w):-

1)         The case of the Complainant is that the Complainant has availed some finance as cash credit from the Opposite Party to a tune of Rs.15,00,000/-(Rupees fifteen lakh)only. The Complainant has deposited all relevant documents of his shop and created mortgage of his house. The Complainant was paying the loan repayment installment regularly till March-2020 amounting to a tune of Rs. 70,000/-(Rupees seventy thousand)only to Rs. 77,000/-(Rupees seventy seven thousand)only biannually. During COVID-19 LOCK Down the Complainant has suffered a lot from all counts. Instead of giving interest rebate the Opposite Party/Bank has demanded Rs. 1,05,000/-(Rupees one lakh five thousand)only to Rs. 1,07,000/-(Rupees one lakh seven thousand)only biannually from the Complainant without any reason. The agent of the Opposite Party without obeying the COVID-19 guidelines have been approaching the Complainant to collect loan repayment at high rate. The Complainant requested several times to the Opposite Party not to impose such heavy loan repayment installment but they are bent upon to do so. Finding no way the Complainant has served pleader notice on 04-06-2021 to the Opposite Party. The Opposite Party has received the notice and gave a denial reply. Hence the Complainant filed this case before this Commission.

 

2)         The case of the Opposite Party is that the Opposite Party did not file version and set ex-parte.

 

3)         After perusal of record it reveals that the Complainant has filed only the pleader notice dated 04-06-2021 and the reply of pleader notice by the Opposite Party dated 29-06-2021. The Complainant has not filed any document regarding loan which he has availed from the Opposite Party. The allegation of the Complainant is that the Opposite Party bank had imposed high rate of interest. But the Complainant has not filed any document on that point. Without loan document it is impossible to decide the case. It is the duty of the Complainant to produce all relevant documents. The Complainant has not filed any documents. Hence the case is dismissed.
