                Complainant is present through his authorized person.

                O.p. is also present through its lawyer. O.p. also filed certain documents as per feristy  which are kept on record. O.p. also filed receipt showing payment of cost of 500/- as per order dated 04-05-2010. Affidavit filed on 13-04-2010 is accepted.

                The case is taken up for hearing.

                Head on both sides. At the time of hearing the complainant files a petition praying for dispose of the case on the ground that he would not continue the case further.

                The petition is shown to the o.p. who raised serious objection on the ground of belated stage of settlement and also submits before us that heavy cost may be imposed upon the complainant for making harassment to the bank.

                Having heard on both sides and also considering the facts and circumstances of the case we dispose of the case for non prosecution with cost of Rs. 500/- to be paid to the o.p. by the complainant. The complainant is directed to pay the cost of Rs. 500/- to the bank within 30 days hereof in default the o.p. is at liberty to realize the same by put the decree into execution thereof.
