Final Order / Judgement

This is a complaint U/S 12 of C.P. Act 1986 filed by the complainant Chandra Bahadur Pradhan where in it is contended interalia to the effect that a sum of Rs. 50,000/- have been deposited in F/D-618 and being Term Deposit no.0954 for the period of 13/07/2007 to 13/07/2008 which would be matured at Rs.54,000/- (Rupees fifty four thousand) only and it was deposited in the O.P. Bank at Nagrakata Branch. Suddenly he found the said branch is under closer without giving any public notice. There after he had been to main branch Jalpaiguri in several times for withdrawing the said deposited amount, but in vain.

Hence, this case.

Inspite of service of process as the O.Ps. did not file W/V to contest the case, the case is disposed of with exparte hearing.

Perused the complaint and relevant documents with meticulous care. On perusal of the same we are satisfied to opine that the contents of the complaint and the documents files in connection with this case being unchallenged remain unrebutted. Resultantly we do hold that the complainant is entitled to get reliefs as sought for.

Thus the case succeeds.

Hence, it is

                                                  ORDERED

That the C.C.No.-51/2013 Under Section 12 of C.P.Act 1986 filed on behalf of complainant Chandra Bahadur Pradhan be and the same is decreed exparte against the O.Ps. Bank with cost of Rs. 1,000/-(Rupees one thousand) only to be paid by the O.Ps. Bank in favour of this complainant within one month from this date.

This O.ps are further by directed to pay off the said entire amount of Rs 54,000/-(Rupees fifty four thousand)only in favour of the complainant within one month from this date, failing which the O.Ps shall pay interest @8% p.a. on the said sum of the Rs. 54,000/- (Rupees fifty four thousand) only to be calculated on and from 13/07/2008 till recovery of the entire decretal dues.

The O.Ps are here by further directed to pay a sum of Rs.10,000/-(Rupees ten thousand) only in favour of the complainant as compensation for his harassment, pain & mental agony.

The O.Ps are further directed to pay of the entire decretal dues with in one month from this date infavour of the complainant without fail in default the complainant is to recover the said entire decretal amount along with interest @8% p.a. on the decretal dues to be calculated on and from the date of filing of this case till recovery of the entire dues by filing a separate proceeding against O.Ps as per provision of law.

The O.ps are further directed deposit a sum of Rs.5,000/- (Rupees five thousand) only in the A/c of State Consumer Welfare Fund with in one month from this date as further compensation
