ORDER

Ld. Advocate of Complainant  filed hazira.

Ld. advocate of complainant filed a verified petition of Sita Devi wife or Arjun Prasad Gupta with a prayer to pass necessary order. Heard the Ld. Advocate and pedused the petition.

The Ld. advocate submitted that after filing of the case the complainant/claimant Sri Arjun Prasad Gupta died in a road accident ,so 20.03.2019 the legal heir of the deceased has filed a petition for substitution before the Commission. On 27.03.2019 necessary documents regarding the legal heirs of the deceased along  with death certificate,  id proof were filed. Thereafter on 14.08.2019 a no objection petition was filed by all the legal heirs , at that time Sneha Gupta was minor subsequently on 16.06.2022 an affidavit from Oath Commissioner, Sikkim  was filed before the commission that they have no objection along with Sneha Gupta now being major, if the cheque is issued in favour of Sita Devi, wife of Arjun prasad Gupta by Bajaj Allianz General Insurance Company Ltd.

 And as such the legal heirs are not wiling to proceed with the case further. Hence , it is

                         ORDERED

thus the instant case is disposed for non prosecution without any cost.

Let the the copy of the order be supplied to the parties free of cost.
