The complainant Abdul Hasib Khan S/o Ekram Hossain Khan of Village and Post Patherchapuri, Birbhum filed a complainant u/s 12 of the Consumer Protection Act, 1986(as amended up to date) against the O.P, the Block Land & Land Revenue Officer, Suri  I, P.O. Barabagan, Birbhum. The complainant applied for K.B.O.R of Khatian No. 442 of Mouza Patharphapuri, J.L. No. 216 in terms of Right to Information Act, 2005 before Ld. D.L. & L.R.O, Birbhum on 03.12.2013. The S.P.I.O and Dy. D.L. & L.R.O of Birbhum directed to the complainant to apply before the B.L. & L.R.O, Suri  I, in due process for obtaining the required K.B certified copy. As per direction the complainant applied for certified copy of K.B.O.R. The O.P failed to supply the copy of K.B.R.O.R as per terms of the R.T.I Act.

The O.P was served with notice of the case but they did not appear to contest. In absence of any challenge or denial from on the part of the O.P the case is taken up for hearing exparte. We have perused the complaint and the documents on record filed by the complainant in support of his contention. Also the complainant has been heard in person. In fact, the complainant being the applicant to the O.P under R.T.I Act, 2005 cannot be claimed to be a consumer under Consumer Protection Act. There is a remedy available for him to approach the Appellate Authority under Section 19 of the R.T.I Act, 2005. (Revision petition No. RP/4061/2010 dated 13.03.2012, NCDRC). Accordingly this case is not entertainable here.

Hence,

O R D E R E D

that C.F case No. 91/2014 be and the same is dismissed. There is no order as to cost.

Copy of this order be supplied to the parties free of cost.
