JUDGEMENT
The crux of the case is that the above named complainant alleging deficiency in service against afore mentioned O.Ps for non payment of salary for the period from January, 1996 to October,1996 a sum of Rs.23,939/- for which the complainant sought for redressal of the grievances raised by the complainant.

On being noticed the O.Ps appeared and filed written version and they submitted in their written version that after receipt of the allotment from the Government they will disburse the above amount to the complainant.
Heard from the complainant inter alia from the O.Ps at length. We perused the complaint petition and the documents filed by both the parties.
FINDINGS.
Undisputedly the complainant was working as V.L.W at Padmapur Block, Dist: Rayagada and also retired on completion of 58 years of age during the year 1996. But till date the complainant has not received the salary for the period from January,1996 to October,1996 a sum of Rs.23,939/- from the O.Ps for some or other plea.
The main grievance of the complainant was that due to non receipt of outstanding salary he has filed this case before the District commission, Rayagada to get the amount.
The O.Ps in their written version submitted that after receipt of the allotment they will disburse the same to the complainant.
During the course of hearing the complainant submitted that the Collector, Rayagada vide their Lr. No. 847/XXIV-54/03 Dt. 19.4.2003 directed the O.P to release the salary of the complainant from civil account.
This District commission heard the submission of the complainant and also of the O.Ps.

The District Commission has seen the age of the complainant i.e. 76 year plus during the course of hearing. At this age money is highly essential for medicine and at this age he could not put forth their grievance to the O.Ps from time to time.
To meet the ends of justice the following order is passed.
ORDER.
In resultant the complaint stands allowed against O.Ps on contest.
The O.Ps are directed to release salary a sum of Rs.23,939/- in favour of the complainant and credit the same in his S.B.account No.11677517505 of SBI, Ambadola Branch immediately from available allotment without awaiting further allotment from the Government. Parties are left to bear their own cost.
This is to be complied by the O.Ps. within 30 days from the date of receipt of this order.
Copies of the order be served on the parties free of cost as per rule.
