            The grievance of the complainant is that he being under below the poverty line was entitled for necessary card and accordingly requested the O.P. for issue of B.P.L. card for availing the benefits as per the guidelines of the State Government of Odisha. The complainant made his attempts from time to time for issue of the B.P.L. card from the year 1997, but it was never issued to the complainant. It is with the knowledge of the complainant that though the aforesaid B.P.L. card was issued in favour of the complainant affixing the photograph and all the details, the said card was used by one Dhanu Pradhan of the same village w.e.f. the date of issue. Due to wrong actions of the Opposite Party in issue of B.P.L. card to one Dhanu Pradhan, the complainant suffered from harassment, causing mental agony for which is entitled for exemplary compensation.

            2. Primafacie, the facts as stated in the complaint petition do not raise any consumer dispute and the complainant can not be considered to be a consumer within the meaning of Section 2 (1) (d) of the Consumer Protection Act, 1986. There is neither buying of goods for consideration nor hiring of services of the O.P. for consideration in the grievance put forth by him.

            3. We are of the opinion the complaint petition is not entertainable by this Redressal Forum. If so advised, the complainant may have his remedy in the civil court having jurisdiction. Hence the complaint petition is not admitted and is dismissed in limine.

            Order is pronounced in the open Forum today on 14th January 2016.

            Copies of the order be supplied to the parties free of cost.
