ORDER

Learned counsel, Mr. C D Rungsung appears for the complainant and Mr. Likhase Sangtam, learned counsel for the respondent 1-3. Fact of the matter is that the complainant, Smti. Sumita Sharma, wife of late Rajesh Sharma has put forth claim of ₹ 42,00,000/- issued by Dimapur Branch Office of the Birla Sunlife Insurance Co. Ltd. under the policy no. 0064443527. The same was filed before the State Commission. However, with the Amendment Act, 2019 the pecuniary jurisdiction of the District Consumer Forum, Dimapur has enhance to ₹1 crore U/S 34. Learned counsel, Mr. C D Rungsung for the complainant submits that the matter maybe referred to the District Consumer Forum so that he may not be deprived of the opportunity of placing his grievances in the appropriate forum and opportunity to avail appeal before State Commission. Mr. Likhase Sangtam, learned counsel for the respondent 1-3 has left the matter at the decision of the forum.

The forum has considered the prayer of the learned counsel for the complainant and allow prayer to give opportunity to the complainant to place the matter before to the appropriate forum and to avail opportunity for appeal in State Commission.

Let the CR be transferred to District Consumer Forum for early disposal.
