Ld. Advocate of the Complainant as well as the OPs are present through their respective Lawyers.

The case is taken up for hearing of argument.  At this stage the Ld. Advocate for the Complainant files an application supported by an Affidavit  praying for dismissal of the complaint on the ground that the dispute in question between the parties have been amicably settled out of the Forum and in terms of the said settlement the OPs have paid Rs.30,000/- (Rupees thirty thousand) only to him as full and final settlement of the claim. Copy is served.

Heard the Ld. Advocates of both sides. Perused the prayer of the Complainant. On perusal of the prayer of the Complainant, it appears that the dispute in question between the parties have been amicably settled out of the Forum and in terms of the said settlement, the Complainant has already received  Rs.30,000/- as full and final settlement.

In view of the aspect, we are inclined to allow the prayer of the Complainant. Accordingly, the complaint is liable to be dismissed for non prosecution. Hence,

ORDERED

That the complaint case be and the same is dismissed for non prosecution as prayed for.

            No order of cost is imposed upon any of the parties.
