Complainant is absent since 01/07/2010. Ld.Advocate-Shri.Kiran Patil for the Opposite Party is present alongwith one Shri.Ankit Gala, the Power of Attorney Holder. He submitted on behalf of Opposite Party that possession of flat in question bearing no.3 B-503, Building No.3, Laxmi-Wadi, Chinchpokli (E), Mumbai -34 is already delivered to the Complainant on 29/04/2010. On the last date Opposite Party has produced on record photocopy of possession receipt and panchanama. It appears that the Complainant has received the actual possession of the flat in question. The Complainant is not interested in proceeding this complaint Hence, compliant is dismissed for want of prosecution. No order as to cost.
