JUDGEMENT

 

            The  factual matrix of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps    for non compliance  of  Letter No. 6299/CA  Dt.22.07.2017  of Controller of Accounts, Odisha, Bhubaneswar  for which  the complainant  sought for redressal of the grievances raised by the complainant.

       That the complainant was working as a Head Master, At: Paik Street U.P. School, Gudari, Dist: Rayagada  in  School and Mass Education Department under Block Education Officer, Gudari and  retired on Dt.30.09.2016 on attaining the age of superannuation i.e. 60 years. The  complainant  submitted  all  pension papers before the O.P. No.1. for  sanction  of pension and  final withdrawal of   G.P.F. In turn  the O.P. No.1 forwarded  the complainants  pension, G.P.F papers   for sanction of  pension and   final G.P. F to the Controller of Accounts, Odisha, Bhubaneswar.  The Controller of Accounts, Odisha, Bhubaneswar  vide their letter No. 6299/CA Dt. 22.07.2017 has returned  to the O.P. No. 1  with a remark  therein the errors, which is required  for  compliance there to.  Above one month has already been lapsed  but   no action has been taken by the O.P. No.1  till date  for   compliance  of the above letter . From time to time  the complainant  approached the   O.P. No.1   to  comply the above objection made by the  Controller of Accounts, Odisha, Bhubaneswar  vide their  Letter No. 6299/CA  Dt.22.07.2017.     But till date the O.P. No.1 has not complied the above letter.   Hence this case filed by the complainant  before the forum  for redressal  of  his grievance. The complainant prays the forum direct the O.Ps. for  compliance  of  Letter No. 6299/CA  Dt.22.07.2017  of Controller of Accounts, Odisha, Bhubaneswar  immediately  inter alia such other relief  as the hon’ble forum deems fit and proper under circumstances of the case  for the best interest of justice.

            On being noticed the O.Ps filed  joint written version. The O.Ps in their written version submitted that the  Letter No. 6299/CA  Dt.22.07.2017  of Controller of Accounts, Odisha, Bhubaneswar was received on Dt.7.9.2017 and after that the O.P. No.1 has  informed  to the complainant  to  come to the office  and put his signature on the final GPF form in part-III. There after the  complainant was living at Pune for medical  treatment and he did not come in time. So the O.P. No.1 has issued letter to his home address and directed the party to attend the office for putting signature on the paper  and coporate the office  for his work vide this office  letter No.1019 Dt. 12.9.2017,  but the complainant did not attend  the office, even he was present at his home.  Then three  reminding  letters was issued to the complainant  from time to time for the same purpose, but there was no response from the complainant. Finally the O.Ps moved to the house of the complainant  and bring him to the office and thereafter his pending work was complianced  and the final GPF of Sri Rath was sent to the Controller of of  Accounts, Odisha, Bhubaneswar vide this office letter No. 1333 dt. 18.11.2017. So no work  is pending  at this level. The O.Ps prays the forum to dismiss the case against the O.Ps for the best interest of justice.

Heard arguments from the    complainant inter alia O.Ps.    Perused the record, documents, written version  filed by the parties. 

This forum  examined the entire material on record  and given  a thoughtful consideration  to the  arguments  advanced  before us by  the  parties touching the points both on the facts  as well as on  law.

                                                    FINDINGS.

            From the records it reveals that, there is no dispute that the  complainant was working as a Headmaster at Paik Street Primary School under Block Education  Officer, Gudari, Dist: Rayagada.  He  was retired on Dt. 30.9.2016 on attaining the age of superannuation i.e. 60 years of age. 

The grievance of the complainant was considered by the O.Ps. the final GPF of Sri Rath was sent to the Controller of of  Accounts, Odisha, Bhubaneswar vide  letter No. 1333 dt. 18.11.2017 O.P. No. 1.

 The O.Ps are committed to the  service  of the public and the O.Ps have acceded to the relief  claimed by the complainant  expeditiously within  their limits being duty  bound  and there is no deficiency in service.

This forum observed the O.Ps. after receipt of notice from the Forum promptly  the complied the pension matter   of the complainant  and there is no deficiency in service on the part of the O.Ps.  The present case in hand the complainant is not entitled any compensation from the O.Ps.

To meet the ends of justice the following order is passed.

ORDER.

Accordingly the case stands disposed off.  There is no order as to cost and compensation.
