(By Advocate Sri. B. Kumar) V/S 1. B.E.M.L. Employees Credit Co-operative Society, Maharaja Road, Robertsonpet, K.G.F., represented by its President Thirunavakarasu, Working as Supervisor, Gear Shop, M.R.S. Gate, B.E.M.L., K.G.F. 2. B.E.M.L. Employees Credit Co-operative Society, Maharaja Road, Robertsonpet, K.G.F., ….Complainant represented by its Secretary Sri. Velu, K.G.F. ….Opposite Parties ORDERS This is a complaint filed under section 12 of the Consumer Protection Act, 1986 praying for a direction against the opposite parties to pay Rs.35,000/- being the matured F.D. amount with interest and costs, etc. 2. It is alleged in the complaint that the complainant deposited Rs.35,000/- on 14.09.2007 with BEML Employees Credit Co-operative Society Limited, K.G.F. repayable after 24 months with interest at 10.25% p.a. payable every month. It is alleged that the interest was received at the agreed rate till the date of maturity and subsequently the OPs went on reducing the rate of interest and that the OPs did not repay the matured amount inspite of repeated requests on insufficient ground. During the arguments the complainant admitted that interest has been received up to 30.11.2009 and the principal amount and the subsequent interest may be ordered to be paid. 3. The OPs remained though served with notice sent by Forum. Complainant filed affidavit in support of the allegations made in the complaint. 4. We perused the records and satisfied as to the truth of claim made by complainant. Hence we pass the following: O R D E R The complaint is allowed with costs of Rs.1,000/-. The OPs shall pay Rs.35,000- (rupees seven lakh fifty thousand only) to complainant with interest at the rate of 7% p.a. from 01.12.2009 till the date of payment, within 45 days from the date of this order Dictated to the Stenographer, corrected and pronounced in open Forum this the 10th day of December 2009.
