                                                            ORDER

 

                        On 11.12.2009, proxy counsel for OP submitted an application for withdrawal of the complaint duly signed by the complainant with his affidavit as the matter has already been settled with the OP and nothing is due against the OP. Since the complainant was not present and at the request of proxy counsel, the case was posted to 15.12.2009 on which date also complainant did not appear and the case was adjourned to 18.12.2009 before the Lok Adalat.

                        Today in the morning, proxy counsel for complainant appeared and stated that complainant would appear afternoon session for making his statement. It is already 3.30 P.M. Case called many times. None is present for complainant. Further wait is not justified. Keeping in view the facts & circumstances of the case, the present complaint is hereby dismissed for default of appearance. The file be consigned.

                        Copies of this order free of cost be supplied to the parties.
