Final Order / Judgement

In this case the Complainant had raised dispute in accounts shown in the account statement claiming the same to be wrong and arbitrarily raised. Complainant's case is that in the month of March, 2012 he had availed loan of Rs.4,00,000/- from the OP Finance Company and after payment of more than Rs.5,50,000/- accounts statement issued by the Opposite Party shows outstanding dues of Rs.7,07,280/-. He has challenged the said dues to be wrong. This case is to be decided exparte against the OP-Finance Company who did not file any written version nor has contested this Case. The Complainant narrating various allegations against the Opposite Party, alleging deficiency in service on his part has prayed for a direction to the OP not to repossess the Finance vehicle and for a direction to the OPs to issue previous loan account, not to charge any amount till completion of the loan, not to charge any DPC and for issuance of NOC etc. The vehicle of the Complainant is still in possession of him and he is using the vehicle throughout the pendency period of this case. The Forum is not empowered to settle the disputes raised in the complaint petition as the same is relates to disputes in accounting in between the parties. However, the OP-Finance Company shall give relaxation in paying the amounts charged under other heads then the unpaid installment dues if the Complainant would be agreed to repay the balance amount required for liquidation of the loan within three months only after issuance of previous loan account statement as claimed by the Complainant.

Accordingly the c.c. Case is disposed of.
