Complaint alleges deficiency in service against the Branch Manager, State Bank of India, Kalunga ADB Branch, Vedvyas, Rourkela, Sundargarh. His grievance is that while availing Gold Loan from the OP-Bank he had entrusted gold ornaments of 55.190mg which includes gold ornaments of various weights as security of the loan. After clearance of the said gold loan the OP-Bank did not return the mortgaged gold ornaments to him despite several approaches and requests. Or perusal of the written version full clearance of the gold loan is admitted by the OP-Bank. OP's claim is that the gold ornaments contained in a packet while return to the complainant he objects to receive and sought for testing for those ornaments by a gold smith. Complainant's prayer for a direction to the OP-Bank to return mortgaged gold ornaments in presence of a hired gold smith of the complainant cannot be termed as in genuine. We therefore, allowing the complaint, direct the OP-Bank to hand over the entrusted gold ornaments of 55.190mg only after proper testing done by the complainant's hired gold smith within one month from the date of receipt of this order. Accordingly the C.C.Case is disposed of.
