On perusal of the pleadings, after going through the documents on record and on hearing the learned counsels, it appears that the dispute rests with the accounts raised in statement of Accounts, which cannot be adjudicated in summary proceedings, However, casting a glance over the entries reflected in statement of accounts, as substantial amount has been paid towards loan wit in contract period with some deviations which are also accepted, in our view, balance amount shown towards installment dues, shall be paid within three months and outstanding dues towards over due interest, including other charges reflected in statement of Account shall be considered to be waived. C.C. Case is disposed of.
