On the strength of withdrawal petition filed by the complainant record is put up today..

          The complainant filed a petition through her learned Advocate with affidavit to withdraw the complaint petition as the matter has been settled Ex-curia between both the parties along with a memorandum of settlement and documents. It is submitted by the Advocate for complainant that both the parties have mutually agreed to settle the pursuance of the amicable settlement and the O.P No. 1 & 2 (Kotak Mahindra Life Insurance Co.Ltd) to pay applicable death benefit to the Complainant after deducting the premium amount and today the complainant being the  nominee with the policy No.09881873 received the amount of Rs.3,47,546/-(Rupees three Lakh Fourt six) only from the above said O.Ps bearing Cheque No.”009722/dt 26-04-2023”

Heard, as the complainant is satisfied with the O.Ps on the basis of Memorandum of settlement and jointly does not want to proceed with the case, this Commission has no hesitation to  allow the petition filed by the complainant.

            Accordingly, the petition is allowed and the present consumer complaint is withdrawn in view of the settlement of claim. and satisfaction of the complainant subject to terms and conditions of the settlement by the O.Ps.

Hence the Present Consumer complainant case is disposed of on the Occasion of 2^nd National Lok Adalat .
