  1. The Brief fact of the Complainant is that the Complainant has purchased a pair of shoes as well as socks from the OP on 23rd December 2021 and paid Rs. 3,657/-. The Complainant money got deducted twice in which the first payment of Rs. 3,657/- got deducted bearing UPI Id 1357225386 and the second deduction of Rs. 3,657/- got deducted bearing UPI Id 135778383. The Complainant raised the issue before the OP but he was not provided with any vivid resolution, such act of the respondent’s is highly unexpected and unprofessional and that the Complainant has been harassed during the whole procedure. The OP has acted like flogging of a dead horse in order to provide resolution which is unprofessional in nature. There was negligence of the OP and the said OP is running an Unfair Trade Practice in order to dupe the hard earned money of the Complainant. The OP has miserably failed in providing right and proper service despite the Complainant has paid the full amount to the OP authority and thereby causing deficiency in service.  The Complainant sent a legal notice on dtd. 01.12.2022 but the OP did not response.
  2. The OP refused to receive the notice. So the OP is set ex-parte.

 

  1. From the above it is found that the Complainant’s money got deducted twice but the OP did not return the excess money to the Complainant. Hence the OP is deficient in service and Unfair Trade Practice.

Accordingly the case is disposed of with following:

                             ORDER

The case is disposed of on merit. The O.P. is directed to return Rs. 3,657/- towards receipt of excess money to the Complainant, Rs. 10,000/- towards negligence, Unfair Trade Practice and deficiency in service to the Complainant as Compensation and Rs. 5,000/- towards cost & litigation expenses to the Complainant within 30 days from the date of order, failing which the amount will further carry with 9% interest per annum till realization.

Order pronounced in the open Court today on 24th day of April, 2023.
