- The Case of the Complainant is that the Complainant had taken two card service from the respondents concern company bearing the profit club No. 92294172777144 and for availing the service the Complainant had deposited a sum of Rs. 10000/-(Rupees ten thousand)only on each card. The Complainant was entitled to receive a product of Rs.1000/-(Rupees one thousand)only every month for the next 12 months. The Complainant had deposited the amount on 8th February 2022 to 31st of July 2023 for the next 13 (thirteen) months. The Complainant had taken the grocery utilizing the card followed by contacted the respondent company for the refund but till date the Complainant had not received the refund. The Complainant has raised his issue to the respondent concern but till date the respondent has not provided the proper service.
Being aggrieved, the Complainant sought redressal before this Commission.
- The case of the Opposite Party is that the Opposite Party did not appear before this Commission. Hence the Opposite Party is set exparte on Dt. 03/04/2023.
- Perused the documents filed by the Complainant and it reveals that the Complainant had availed Big Bazar profit club membership card having card number 92294238802480, having validity from the date 08/02/2022 to 31/07/2023 of Rs. 10,000/-(Rupees ten thousand)only each. The Card was availed to get service from the Big Bazar. The Complainant used the card for 2 months for purchasing grocery items. The card was issued to get service from the Opposite Party to receive product having value of Rs. 1000/-(Rupees one thousand)only till 13 months but the Complainant did not receive any service from the Opposite party after 2 Months. The Complainant contacted as well legal notice was sent on Dt. 08/06/2022. After receiving the legal notice the Opposite party remained silent. A customer deposits his hard earned money in Order to get benefit but in this case the Opposite Party failed to do so. Hence the Opposite Party is deficient in its service by harassing the Complainant for not refunding the deposited money.
Accordingly it is ordered.
O R D E R
The Opposite Party is directed to refund the deposited money of Rs. 18,000/-(Rupees eighteen thousand)only in profit club member to the Complainant to @ 7% per annum from the date 08/06/2022 till realization. Further the Opposite party is directed Rs. 10,000/-(Rupees ten thousand)only for mental harassment and Rs. 10,000/-(Rupees ten thousand)only towards litigation cost. Failing which the entire order will carry 12% P.A. till realization.
