Today is fixed for admission hearing.

After having heard the complainant’s representative in person and after perusing the material available on record we see that the case has resulted from a person loan transaction of Rs. 6,50,000/-. It is stated by the complainant that the loan was amenable to liquidation with interest @9.18%p.a. and that the chargeable processing fees was only 2%. According to him, the financier (OPs) have, violating their earlier promise, has charged interest @19%p.a. and Rs.36, 000 as processing fees. But he has not filed any document to substantiate his verbal claim. Rather the documents filed by him are clear enough to show up that the rate of interest was 19%p.a. and that the processing fees as charged for him is consistent. The copy of agreement which he has filed in support of his complaint nullifies his case as to lesser rate of interest and lesser amount of processing fees.

Therefore, it is clear that his case does not merit acceptance.

Hence it is ordered that the case be and the same is dismissed as being not admitted.

Let a plain copy be given to the parties free of cost as per CPR.
