          This is a complaint filed u/s 12  of Consumer Protection Act, 1986 for directing the Opposite Parties  to immediately give the insured amount of Rs.27,388.20 for the stolen motor cycle bearing Regn. No. PY 01 BS 0670;  to direct the opposite parties to pay a sum of Rs.50,000/- towards compensation for mental agony, pain and sufferings which the complainant has suffered all these days due to deficiency in service and unfair trade practice; to direct the opposite parties to pay a sum of Rs.10,000/- towards the cost of the proceedings.        

          2. Notice to the opposite parties were duly served and the opposite parties appeared through their Counsel.   Hence, the matter was posted for complainant's side evidence.  

          3. Today this complaint was called.  Complainant absent.  Counsel for complainant present.  Opposite Parties called absent.  Counsel absent, no representation made.  Counsel for complainant filed memo and withdrawn the complaint.  In view of the memo filed by the Counsel for the complainant, this complaint is hereby dismissed as withdrawn.  The memo is the part and parcel of the order.    No costs.

          It is humbly submitted that the above said case is posted today for enquiry by the complainant's die before this Hon'ble Forum. 

Further it is humbly submitted that the complainant herein is admitted in Hospital and he is not in position to attend the case.  Hence, in this stage, the complainant withdraw the case without prejudice to file any fresh complaint before this Hon'ble Forum, Puducherry. 

          Therefore, it is humbly prayed that this Hon'ble Forum may be pleased to record this memo and pass order in the interest of justice.
