            The case record is advanced today on the strength of a memo filed by the learned advocate for the complainant.  It is contended therein that the complainant does not want to proceed any further in this case and will not be prejudiced if the case will be dropped. 

 

            Sri Pradeep Kumar Panda, Advocate appeared on behalf of O.P.No.2 & 3 files Vakalatanama  on 27.12.2021 alongwith a memo of satisfaction letter dated 15.12.2021 from the complainant. Sri   Manu Swain contended therein that  the grievance of the complainant has already been redressed and confirmed that the Company has already replaced the defective product (Model No. L39HS100C Sr. No-SCKG39HS01175) in lieu of full and final satisfaction as per settlement of all the claims of the complainant and nothing hereinafter remains and the complainant has no further claims against the Company. The complainant hereby agrees to withdraw the said consumer case. Further stated that the present settlement has been entered into by the complainant out of his own free will without any pressure or coercion and the complainant is undertake to abide by the terms of the settlement.

               Perused the memo and verified the record, documents submitted by the advocate for complainant and O.P.No.2 & 3. It is ascertained from the record that in terms of the settlement the present dispute has already been settled by both the parties out of this Commission.  As thus the complainant do not want to proceed with the case further and filed the memo in advance to withdraw the case, hence the case is dropped as not pressed. The post of both Members are lying vacant.

            Issue copy of order to the parties free of cost.
