Present:  Rose Jose, Hon’ble President:

            Complainant absent, opposite party represented jointly the petition was filed as C.C.No.401/2016 and that was dismissed for default due to the continuous absence of complainant.  And thereafter petition for the same cause of action (C.C.241/2017) was filed and this was dismissed for the same reason for default.  Again on 28.12.17 this complaint is filed by him and the case was posted for proof affidavit of the petitioner from 30.04.18 onwards.  But the complainant was continuously absent, no representation no affidavit filed.  Hence the petition is dismissed for default.
