Asst.Engineer,KSEB, Electrical Section, ; Opposite party Manjeshwar,Kasaragod ORDER SRI.K.T.SIDHIQ : PRESIDENT Shortly stated, the case of complainant Budankhan is that he is an electricity consumer under the jurisdiction of the Manjeshwar KSEB electrical section. The cable through which connections provided was damaged in lightening and thunder and it was repaired and connection was restored. Budankahan requested to give connection through overhead line. He has paid the OYEC and the CD at the time of applying connection. But the opposite party is not giving the connection through overhead line. The electric connection given through cable line was only a temporary arrangement and the cables for the same wire purchased by Budankhan. The opposite party has not provided the electric connection through LT line till date. Hence the complaint seeking a direction to opposite party for providing electrical connection through LT line. 2. According to Asst.Engineer , Electrical Section, Manjeshwar, the connection was provided through underground cable, since to provide electric connection to Budankhan an extent of 50 meter overhead line has to be drawn and for which one electric post ought to have erected, this fact was intimated to the complainant. Therefore, in order to get connection immediately for reducing the expenses for drawing electric line and to overcome the obstructions of property crossing, complainant filed application for electric connection through underground cable and the connection was provided on 20/5/2002 after complying all the formalities. Since the underground cable connection became defective now Budankhan insisting for connection through overhead line. As per the rule if the underground cable is defective , the consumer has to bear the expenses for replacing the cable. But instead of purchasing cable at his expense now Budnkhan is praying for an order against kSEB to draw the line by themselves at their expenses 3. As per the present rules to provide overhead connection, the consumer has to bear the expenses for the same. To provide such connection to complainant, the amount required is Rs.5800/-. If the consumer is not paid the amount then the board has no way to provide overhead line electric connection. 4. Neither the complainant nor the opposite party have adduced any oral evidence. The opposite party produced a circular No.BO.383/2001(plg.cons 3482/97 dt,16/2/01 as per which it is stated that the consumer shall purchase and supply LTUG cable and accessories free of cost and the consumer shall do the work of laying cable as per standards under board’s supervision. The circular further provides that if the cable or its accessories become defective, the consumer shall procure and supply the cable and accessories or rectify the defect free of cost to the Board and the consumer shall bear the laying charge. 5. Therefore, it is clear that only at the expenses of the consumer the underground cable has to be replaced. According to opposite party, if the complainant deposits a sum of Rs.5800/-, then the KSEBoard will provide connections by drawing overhead line. We do not find any reason to insist the opposite party to suffer the cost for shifting the electricity connection to Budan khan from under ground cable line to over head line. In the result, the complaint fails and dismissed without costs. MEMBER MEMBER PRESIDENT eva/
